These Terms of Service ("Terms") govern your access to and use of Matesa AI ("Service"), provided by Matesa AI ("Company", "we", "us", or "our"). By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Description of Service

Matesa AI is an industrial product identification and procurement intelligence platform that uses artificial intelligence to:

• Identify industrial products, parts, and materials from images or text descriptions
• Provide technical specifications, pricing, and supplier information
• Suggest alternative products and procurement sources
• Generate technical documentation and reports

3. User Accounts

3.1 Registration

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Subscription Plans

4.1 Free Plan

Our Free plan allows 20 product searches per month without payment. Usage limits may change at our discretion with notice.

4.2 Pro Plan

The Pro plan is a paid subscription offering unlimited searches and advanced features. Pricing is displayed on our Pricing page and may be updated with 30 days notice.

4.3 Enterprise Plan

Enterprise plans are subject to separate agreements and custom pricing.

5. Payment Terms

Subscription fees are billed in advance on a monthly or annual basis. You authorize us to charge your payment method for all fees. Subscriptions automatically renew unless cancelled before the renewal date.

5.1 Refund Policy

We offer a 30-day money-back guarantee for new Pro subscriptions. Refund requests must be made within 30 days of initial purchase. Annual subscriptions are prorated if cancelled mid-term.

6. Acceptable Use

You agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to reverse engineer, decompile, or extract the AI models
• Use automated scripts or bots to access the Service without permission
• Upload malicious files, viruses, or harmful code
• Violate intellectual property rights of others
• Resell or redistribute our Service without written permission
• Use the Service to compete with or harm our business

7. Intellectual Property

7.1 Our Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, software, and AI models, are owned by Matesa AI and protected by copyright, trademark, and other intellectual property laws.

7.2 Your Content

You retain ownership of images and data you upload. By uploading content, you grant us a limited license to process and analyze it solely to provide the Service. We do not claim ownership of your uploaded content.

8. Data Privacy

Your use of the Service is also governed by our Privacy Policy. We collect and process data as described in the Privacy Policy. Uploaded images are automatically deleted after 30 days.

9. AI Limitations and Disclaimers

You acknowledge and agree that:

• AI-generated results may contain errors or inaccuracies
• We do not guarantee 100% accuracy of product identification
• Pricing and sourcing information is indicative and should be verified
• You should always consult manufacturer datasheets for safety-critical applications
• We are not responsible for procurement decisions made based on our Service

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MATESA AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. You may cancel your account at any time from your account settings.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Mumbai, India.
